Municipal Property Tax Appeal Defense
Zabel Schellenberg represents Connecticut towns and cities in property tax assessment appeals, valuation disputes, exemption litigation, and related municipal tax matters. Our attorneys work with municipal assessors, elected and appointed officials, and other municipal personnel to defend assessments and address disputes concerning the administration of local property taxation.
Assessment litigation can raise significant issues for municipal finances and the consistent administration of property tax law. Our experience representing municipalities and taxpayers helps us evaluate disputed valuations, anticipate arguments, and develop strategies grounded in the applicable statutes, assessment record, and municipality's objectives.
Defending Municipal Assessments and Exemption Determinations
Our attorneys represent municipal clients in disputes concerning commercial, residential, industrial, mixed-use, and specialized property assessments. We analyze the relevant valuation evidence, applicable assessment procedures, and legal issues underlying the challenge, and work with assessors and valuation professionals where their input is necessary.
We also handle matters involving property tax exemptions, assessment classifications, income-and-expense reporting requirements, and other statutory issues affecting municipal assessment practices.
Our work is informed by substantial experience in municipal law and civil litigation. We recognize the need to evaluate not only the merits of an individual appeal, but also its potential implications for municipal administration and other assessments.
Trial and Appellate Representation
We represent municipalities in negotiated resolutions, Superior Court property tax appeals, and further appellate proceedings when warranted. Our attorneys work closely with municipal clients to assess the record, identify significant factual and legal questions, and develop an efficient litigation strategy.
In Greenwich Retail, LLC v. Town of Greenwich, the Connecticut Supreme Court affirmed a decision in favor of the Town of Greenwich in August 2026 concerning the requirements of Connecticut General Statutes § 12-63c for commercial property income-and-expense disclosures. Attorney Owen T. Weaver represented the Town before the Supreme Court, with Attorneys Barbara M. Schellenberg and Jeremy A. Gustafson on the brief.
Our approach is to provide responsive, prepared, and practical representation that accounts for both the specific appeal and the broader responsibilities of municipal government.
