Strict Foreclosure & Foreclosure by Sale
Zabel Schellenberg represents municipalities in judicial foreclosure proceedings involving delinquent property taxes, including strict foreclosure and foreclosure by sale. Our attorneys guide municipal clients through the legal and practical decisions that arise when an unpaid tax lien must be enforced through the courts.
Although both remedies may be available in municipal tax lien matters, the procedures differ significantly. The property's value, the nature of the debt, the interests of owners and other encumbrancers, and the potential consequences for the municipality all warrant careful assessment. Our approach combines thorough pre-suit review with attention to court procedure, changing account information, and opportunities for appropriate resolution.
Evaluating the Appropriate Foreclosure Procedure
Before seeking judgment, we review the relevant tax and land records, ownership history, mortgage and lien interests, and other information necessary to evaluate the case. We work with municipal officials and title professionals to identify potential complications, including competing interests, missing parties, prior foreclosure proceedings, or changes in ownership.
The choice of foreclosure relief may affect the course of the litigation and the municipality's ultimate position. We advise clients on the applicable procedures, required evidence, practical consequences, and court approval involved, while recognizing that the court determines the relief to be ordered.
Strict Foreclosure
In a strict foreclosure proceeding, the court may establish law days by which parties with redemption rights must act. If the property is not redeemed in accordance with the judgment, title may vest as provided by the judgment and governing law, without a judicial sale.
These proceedings require careful attention to the parties' interests, the debt and supporting evidence, notice and service, the judgment, and any applications to open or modify the judgment. We assist municipal clients in addressing those requirements and, when necessary, related post-judgment documentation and land records matters.
We also evaluate the practical consequences of a potential transfer of ownership to the municipality, where that is an available outcome, alongside the municipality's broader objective of recovering outstanding taxes.
Foreclosure by Sale
Foreclosure by sale involves a court-supervised process for selling the property and addressing the resulting proceeds according to the judgment and applicable legal priorities. The procedure may require an appointed committee, an appraisal, sale-related notices, court review, and additional proceedings after the sale.
Our attorneys assist municipalities throughout the litigation and sale process, including preparation for judgment, coordination concerning sale orders, evaluation of payoff and redemption developments, and review of the post-sale steps necessary to conclude the matter. Because payments, bankruptcy filings, or other developments can affect a pending sale, ongoing communication and attention to court orders are especially important.
Resolution and Post-Judgment Matters
Foreclosure cases do not always proceed as initially expected. A property owner or encumbrancer may tender payment, a necessary party may need to be added, the court may require additional notice, or developments in another proceeding may affect the case. We monitor these changes and advise our municipal clients on appropriate next steps.
From pre-suit evaluation through final judgment, sale proceedings when applicable, and related recordings, our work emphasizes procedural care, accurate records, and efficient communication. We aim to help municipalities enforce valid liens while making informed decisions about the costs and consequences of litigation.
